Getting Orders of Protection in Kendall County

In Illinois, you can obtain a temporary order of protection on an emergency basis if you or other family members are facing an immediate threat of violence. This emergency order can be issued ex parte (without notifying the accused). For the order to be extended beyond the initial 21 days, however, the accused must be served and allowed to defend him or herself at a hearing. At the hearing, the judge can extend the order for up to 2 years if deemed necessary.

Purpose of Orders of Protection

Depending on the circumstances of the complaint, an order of protection can restrict someone from contacting a victim by phone, email or other means. It can also restrict proximity to the victim including restricting access to the family home and suspending child custody and visitation rights. If the terms of the order are violated, law enforcement must respond and such violations can result in criminal charges.
