In Illinois, child support payments are calculated according to statute set forth in the Illinois Marriage and Dissolution of Marriage Act (750 ILCS 5/). Some major modifications were recently made to the law determining how child support is calculated, and this new law went into effect in July 2017.

The new child support law defines guidelines that the court should follow when calculating the amount of child support a non-custodial parent will be required to pay. Rather than basing this amount solely on a percentage of the non-custodial parent’s net income, the Illinois Department of Healthcare and Family Services will determine a base amount of money needed to maintain the standard of living that the child would have enjoyed had the parents not dissolved their marriage. That amount will then be divided between the parents, taking into account each parent’s amount of parenting responsibilities, as well as their individual net incomes.

In addition to the above child support expenses, the court may order one parent to contribute to daycare expenses, medical expenses, educational expenses and extracurricular expenses.
